These Terms of Use ("Terms") govern your access to and use of the website and services provided by In2Track Solutions ("In2Track", "we"). By using the service you accept these Terms. If you do not agree, do not use the service.
1. The service
In2Track is a SaaS compliance management platform that lets organizations centralize evidence, requirements, ownership and expiration dates. We may modify, suspend or discontinue features at any time, providing reasonable notice when changes are material.
2. Account and registration
- You must be at least 18 years old and have legal capacity to enter contracts.
- You are responsible for the accuracy of the data provided when creating an account.
- You are responsible for keeping your credentials confidential and for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use.
3. Acceptable use
When using the service you agree not to:
- Violate applicable laws or third-party rights.
- Attempt to access, scan or probe the vulnerability of the system without authorization.
- Interfere with the operation of the service (denial of service, abusive scraping, malware).
- Upload illegal, defamatory, fraudulent content or content that infringes intellectual property rights.
- Resell, sublicense or commercially exploit the service without our written consent.
4. Subscriptions and payments
Some plans require payment. Prices are shown on the pricing page or in your commercial agreement. Subscriptions renew automatically at the end of each period unless previously cancelled. Applicable taxes are added to the price. Payments are non-refundable unless required by applicable law or expressly stated by us.
5. Intellectual property
5.1 Our property
The service, its software, trademarks, logos, documentation and associated content are owned by In2Track or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service in accordance with these Terms.
5.2 Your content
You retain ownership of all content you upload (evidence, documents, configurations). You grant us a limited license to host, process and display that content solely for the purpose of providing the service to you. You are responsible for ensuring your content does not infringe third-party rights or applicable laws.
6. Personal data
The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.
7. Third-party services
The service may integrate with third-party products. We are not responsible for the content, practices or policies of those services. Your use of them is governed by their own terms.
8. Availability and support
We make reasonable efforts to keep the service available 24/7 with a monthly uptime target of 99.5%. Interruptions may occur due to scheduled maintenance, force majeure or causes beyond our reasonable control.
9. Limitation of liability
To the maximum extent permitted by law, In2Track will not be liable for indirect, incidental, special or consequential damages (loss of profits, data or use). Our total aggregate liability for any claim arising from the service is limited to the amount actually paid by you during the twelve months preceding the event giving rise to the claim.
10. Disclaimer of warranties
The service is provided "as is" and "as available". We do not warrant that it will be error-free, uninterrupted or meet all your specific requirements. We disclaim implied warranties to the extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless In2Track against third-party claims arising from your use of the service in breach of these Terms or third-party rights.
12. Termination
You may terminate your account at any time. We may suspend or terminate your access if you breach these Terms or if your use puts the service or other users at risk. After termination, your access ceases and we will delete your content in accordance with the retention policy described in the Privacy Policy.
13. Governing law
These Terms are governed by the laws applicable in the jurisdiction where In2Track has its registered office. Any dispute shall be submitted to the competent courts of that jurisdiction, without prejudice to mandatory consumer rights.
14. Changes
We may modify these Terms. We will publish the updated version on this page and, if changes are material, we will notify you with reasonable advance notice. Continued use of the service after the effective date constitutes acceptance of the new Terms.
